Terms and Conditions for Rental of "Alta Vista
Chalet"
By answering the question “Have you read the "Terms and
Conditions for Rental of Alta Vista Chalet"? in the
affirmative you agree that you have read and understand
these terms and conditions and agree to abide by them. You
understand and concur that, for reasons of expedience and
for your convenience, we do not require mailing or faxing a
formally signed Rental Contract but that, instead, this
document, together with the personal data submitted with the
e-mail into which it is incorporated, serves as a binding
Rental Contract. Specifically, you agree to unconditionally
pay such charges as may be presented to you in writing and
may result from careless treatment of the premises and/or
not following these terms and conditions.

K, 1MBR with K-sultan, 1 BR with Q, 1 BR with 2T) and 3
1/2 BA (one with Jacuzzi tub and separate shower, two with
shower only, one guest bath)
Provisions and Restrictions:
Occupancy Restrictions:
No more than 8 people, excluding infants under 10 months
of age; children are welcome, but the number of children
may not be more than the number of adults in your party.
Exceptions must be confirmed in writing.
Pets and Smoking:
No pets are allowed under any circumstances; smoking not
permitted inside the premises.
Amenities:
Panoramic views from all rooms, gas fireplace, gas
barbeque grill, 2 levels of large wrap-around view decks,
plus ground level deck off lower-level MBR with hot tub
built into deck, 3-car garage, W/D, DW, microwave, 37"
flat-screen TV, DVD, phone with free LD (assuming "reasonable" use),
free wireless Internet.
Pricing and Availability:
The property is subject to price and availability changes
without notice, until executed contract has been returned
to the property owner. No reservation is confirmed until
approved and the full deposit has been received. All
reservations are final. Time is essential. With the
occasional exception of mailing checks, all communication
is by e-mail. Guest is advised to set his spam control
and/or e-mail system to accept mail coming from
klaush@acviews.com.
Payments:
Two payments are required: a $600 refundable security
Deposit and the rental Balance (consisting of the sum of
(a) total rent, (b) cleaning/processing fee, and (c) 10% Town of Truckee Transient
Occupancy Tax on rent).
Payment of the Deposit is required to hold the reservation
and is only acceptable by credit card via PayPal
(no fee applies to this payment).
If the rental date is within 30 days from date of booking,
payment of the rental Balance is due immediately and can
only be made via PayPal – no fee applies.
If the rental date is further out, the rental Balance is
due no later than 30 days prior to the rental date and may
be paid by personal check (U.S. Bank only) or by credit
card via PayPal, in which latter case a 2% credit card fee
applies. For all credit card payments, the Owner will
issue a “Payment Request” through PayPal via e-mail to the
renter, upon which the renter can conveniently and
securely complete the payment; no PayPal account is
required. A late payment of $50 will be automatically
deducted from the deposit for any check payments received
after the due date, and for any credit card payments
delayed without reasonable cause more than 24 hours from
the time the request was issued. If payment is not made
within 5 days of due date, the reservation will be
canceled ant the property will be opened up for other
rentals, and money paid shall be forfeited. Reservations
may be reinstated, and forfeited money reapplied, upon
payment of the amount due, if the property is still
available, at the Owner’s discretion. You WILL NOT be
reminded on any payment due dates except credit card
payment of the rental Balance.
Cancellation Policy:
The time factor is critical in vacation rentals, and your
reservation will hold this rental off the market for a
period of time. For cancellations made more than 30 days
prior to your arrival date, we will refund all rents paid
but YOU WILL FORFEIT YOUR ENTIRE DEPOSIT. THERE ARE NO
REFUNDS OF RENT FOR CANCELLATIONS MADE LESS THAN 30 DAYS
PRIOR TO ARRIVAL (you forfeit your entire rent, but we
will refund your deposit and cleaning fee only if it had
been paid in full).
As a courtesy to our customers, in the event of a
cancellation, the owner will work to find a tenant to
occupy the vacated time reserved under this contract. If
we are able to find a suitable tenant, we will refund both
the deposit, cleaning fee, and rental fee to the extent we
have found an acceptable tenant for the time period, as
determined by the Owner, less a $100 service fee. The
earlier you warn us that you may need to cancel, the
better the chances of re-renting.
Furthermore, the owner will work with you in the event
that your cancellation is due to documented serious illness. THESE ARE
EXCEPTIONS TO OUR POLICY TO BE EXERCISED AT THE OWNER’S
SOLE DISCRETION.
Weather Related Inconveniences:
As is the case with many vacation rental properties
located in the High Sierra mountains, weather conditions
may be adverse both for arrival and/or departure. Alta
Vista is located on a road that is on the regular snow
removal route of the Town of Truckee. In addition, our
property has essentially level street access, and we
provide a private driveway snow removal service at
minimum once per day, if snow accumulation exceeds 4
inches. Typically, only very minor -- if any at all --
accumulation of snow immediately at the garage doors
cannot be covered by that service and is all that you
might have to clear yourself -- shovels are in the garage.
Commensurate with the 7300 ft. elevation of Alta Vista,
heavy snow and snow drifts can occur, and -- as would
apply for all winter sport resorts -- we advise our
renters
to use a 4-WD or, better yet, an AWD vehicle and to plan
to arrive during daylight hours if very heavy snowfall is
in the forecast. The Owners will not be responsible for
any losses to renters due to snow conditions.
You agree to assume responsibility for transportation to
and from the property. Inconvenience caused by weather,
disruption of utilities, or road conditions do not
invalidate this Rental Agreement, nor will they be cause
for any financial compensation or any other concessions.
Specifically, owner assumes no responsibility if you
cannot arrive at, or depart from, the rental property at
the agreed-upon timing. While owners might make
some ad-hoc arrangements to reduce such costs
arising to you, e.g., if you stay on -- rental calendar
permitting -- because of adverse driving conditions, such
arrangements are not entitlements and must be clearly
confirmed by owner in writing.
You are responsible for your choice:
This vacation rental unit is individually owned and
managed. We have described our vacation rental home in
detail to the best of our ability, but we cannot make the
decision for you and will not be responsible if you are
not happy with your choice on arrival. The rent will not
be refunded and cannot be transferred to another location.
Reviews:
The owner encourages renter reviews in the website through
which this rental was initiated, provided that said
website offers the possibility of renter reviews. However,
renter agrees:
(a) not to post reviews accessible to the general public
anywhere other than to said website
(b) irrespective of the review policy pertaining to said
website, if the review rating is less than 5/5 (five
points of five possible points),
to discuss the intended review, in writing, in all detail
with the owner prior to publication/posting and, in the
event that owner and renter do not come to an agreement
about the reasonableness and fairness of the intended
wording and rating of the review, not to present the
review to said website or any other site open to the
public.
(c) Owner and renter agree to submit and abide by the
result of independent arbitration according to the
provisions of the State of California, for which process
Renter pays all related costs.
Pets, Smoking:
No pets are allowed. Smoking is not permitted anywhere
inside the premises. No exceptions. Owners’ representative
may check for compliance. Violation will result in loss of
the entire deposit.
Occupancy Limitations/Usage/Subletting:
The owners have set strict occupancy limitations (8
people) and extend further discounts to 6-, 5-, or
4-person occupancy parties. Regardless of the number of
sleeping accommodations available in the home, there shall
be no occupant older than 10 months beyond what is stated
on the e-mailed Rental Confirmation. If more persons
occupy the premises that are not specifically authorized
by the owners, or if an extraordinary gathering takes
place at or on the premises, this may cause a forfeiture
of the deposit and eviction. We recognize the desire to
have an occasional visitor, but additional charges may be
incurred for other unauthorized use. In addition, any type
of subletting is strictly prohibited. Any disturbance
resulting in neighborhood complaints or Tahoe/Donner
Association or police action, other illegal activities,
damage to the vacation rental, or violation of this
agreement or of rules and regulations governing the
vacation rental, will be considered sufficient cause for
immediate termination of your stay, and all monies paid
will be forfeited. If damages exceed the amount of
the security deposit, you are liable for such additional
amounts. This agreement does not create a tenancy for the
vacation rental; you can be removed from the premises
without process of law if you do not depart at the
appropriate time.
Reservation/Security Deposit:
A reservation/security deposit (“Deposit”) is required for
all rentals and will be returned subject to, but not
limited by, the following:
(a) no damage to the premises beyond normal wear and tear;
(b) no excess cleaning requirement and/or no negligence
due to not following the check-out list;
(c) no items missing from the premises ($30 replacement
fee for missing TD passes);
(d) garbage not removed from house (to be placed in
bear-proof enclosure); and
(e) there are no unpaid, late, or outstanding rent or
other charges owing.
Any material breach of the lease agreement or the general
or specific home rules during your tenancy may be, in the
sole judgment of the owner, cause for forfeiture of up to
the entire deposit. Deposit refunds are mailed within 21
days of departure or receipt of the house phone bill,
whichever is later.
Upon Arrival:
When you arrive, please check the vacation rental premises
for cleanliness and damage. Read the About This Home
materials (on TV stand or kitchen counter) and Check-Out
List (on countertop or refrigerator). Notify owner
promptly of any problems or damage. You agree to leave the
vacation rental premises in good condition and complete
and check all items on the Check Out List prior to
departure.
Check-In and Check-Out; Key:
Check-in time is 3:00 PM. Upon payment of all rental
charges, you will receive the information necessary to
obtain entry to the premises. The check-out time is 11:00
AM. Late check out, unless pre-arranged with owner, is
grounds for security deposit claims. Owner will grant
early check-in (12:00 noon) and/or late check-out (2:00
PM) if, AND ONLY IF,
at 5:00 PM on the date prior to scheduled check-in the
rental calendar at www.acviews.com/ac/fv.htm
does not indicate that another rental is ending on the
check-in date and/or no another rental is starting on the
check-out date, respectively.
Linens and Towels:
Available for your use; beds are made upon your arrival.
Washing linens and towels is expensive in terms of
housekeeping time and resources. We provide one fitted and
one flat sheet per bed and one towel set (bath, hand, and
face towel) per person on towel racks. More supplies are
in the closets. However, if you use more than one set of
sheets per bed and/or more than one set of towels per
person during your stay, we ask that you wash and dry
those and leave them folded on the dryer before you
depart, or we will deduct $10 per extra set of sheets and
$10 per extra set of towels from your deposit.
Cleaning/Processing/Housekeeping Fees/Policy:
--- The cleaning fee exhibited on the Rental Confirmation
page -- sometimes specifically "waived" -- includes normal
housekeeping services. If we find, in our sole judgment,
that extra cleaning is required, we will deduct the excess
housekeeping fee charged to us from your deposit. This
includes work such as: excess use of linens and towels
(see above), moving furniture to their original position;
professional or spot carpet cleaning; kitchen appliance
cleaning, if required after your stay; etc.
--- You are welcome to use our bath robes, but you will be
charged $10.00 from your deposit for each bath robe not
washed and dried before you depart.
--- Please place all items to be washed by our
housekeepers on top of the washing machine. We may offer
you a substantial cleaning expense rebate if you do all
washing and drying (fitted and flat sheets, towels, dish
towels) and leave all these items folded on the dryer.
--- To request to do laundry services yourself and receive
this rebate, you must do so at the time of signing this
agreement.
Hot Tub:
The hot tub is built into the deck off the master bedroom.
Availability of the hot tub at any time of the year is our
goal. We will make every reasonably possible effort to
keep it functioning even during
heavy snow periods, but, as is the case for all
appliances, we are unable guarantee this.
Use at Your Own Risk:
The Owners and Agents are not responsible for personal
injury or loss, theft or damage to your belongings during
your stay due to causes outside of Owners’ or Agents’
control, or due to unsafe use of the premises and
amenities, including but not limited to the hot tub,
sauna, Jacuzzi tub, gas fireplace, gas grill, and decks.
In particular, in the cold season, snow and ice may build
up on decks, outside stairs, and in the driveway, causing
slippery conditions that may lead to personal injury. You
agree to hold Owners and Renters harmless in the event of
related injury or loss, theft or damage. Guests are not
permitted to use Owner’s sports equipment or other gear
that may from time to time be left in the garage (e.g.,
motor vehicle, sailboat, kayak, raft, bicycles, skis). The
owners and agent are not responsible for their renters’
and guests’ own and their children’s safety while at the
rented vacation home. Guests are permitted to use the gas
grill at their own risk, provided it is placed at least
12” away from the house wall when in use, and the grease
catcher is in place and operable.
Utilities, Telephone, Internet:
Utilities are included in the rental price. You have
unlimited use of the telephone for local calls, as well as
reasonable use of the house phone
for long-distance (LD) and international calls. For LD and
international calls longer
than approx. 10 minutes per day use your own billing. Cell
phone coverage (by various providers, including Verizon
and AT&T) is available at the home location. Free
wireless Internet is available; the password will be
provided upon receipt of all rental fees.
Resort Restrictions:
Tahoe/Donner is a resort with strict homeowners
association guidelines and assesses significant fines if
these regulations are not observed. These regulations
include, but are not limited to:
--- no smoking on the trail system (May – October);
--- no trespassing onto neighboring properties (there are
no fences!) or onto commons (stay on trails!).
Renter will be responsible for all violations committed by
his/her party.
Keys:
Arrival: A code to keyless entry (on the front
door) will be provided to you once the final payment has
been received. First push the "Schlage" button; the keys
will then be illuminated. Enter the code and turn the knob
clockwise to open the dead bolt. To lock, simply push the
"Schlage" button and turn knob counter-clockwise. There is
also a conventional key lock box, operable with
the same code. It contains a mechanical door key which can
be used in case the keyless entry system malfunctions.
Two wall-mounted garage door openers are also available,
identically coded.
Departure: Follow and check the Check-out List posted
in the home -- disregard will result in claims on your
deposit.
