Terms and Conditions for Renting Alegria

By submitting the down payment for rental of Alegria you agree that you have read and understand these terms and conditions and agree to abide by them. You understand and concur that, for reasons of expedience and for your convenience, we ("Owners") do not require mailing or faxing a formally signed contract or Rental Agreement but that, instead, this document, together with the e-mail exchange leading to your down payment, serves as a binding Rental Contract. Specifically, you agree to pay such charges and reasonable delinquency fees as may be presented to you in writing and may result from careless treatment of the premises and/or not following these terms and conditions. And you agree that any controversy or claim arising out of, or relating to, this rental agreement, or the breach thereof, may be determined by mediation-arbitration as commonly practiced for resolution of real estate rental related disputes in the State of California, USA. If the arbitration results in a judgment that is more (less) favorable to the Owner's position, Renter (Owner) pays for all related costs and court fees, except for Owner's (Renter's) legal counsel, if any.

Apartment Details:

Address: Avenida Frontal -- Rua de Paz, Bairro Lindo Horizonte, Abadiania-GO, Brazil, Apartment 405;
-- 1 Bedroom (with Q-bed -- 2 mattresses);
-- Living room with 1 T-bed, 1 sofa, 1 couch table etc.;
-- Kitchen-dining area;
-- 1 Bathroom with toilet, sink, and walk-in shower;
-- Large Covered veranda with wide floor-to-ceiling sliding glass doors to LR and BR, seating area, 2 recliner chairs, and two hammocks;
-- wheelchair accessible; however, a steep driveway leads from street level 5 m down to the floor level of the apartment.

Provisions and Restrictions:

  • Occupancy Restrictions:  No more than 3 people; children require separate ad-hoc permission. All exceptions must be confirmed in writing.
  • Pets and Smoking:  No pets are allowed under any circumstances; smoking is not permitted inside the premises, but OK on veranda.
  • Amenities:  Panoramic views from all rooms and deck, kitchen with 4-burner gas cook-top, toaster oven, refrigerator, electric water kettle, drinking water dispenser, shared laundry facility, unlimited free wireless Internet, hotel room-type private safe).

Pricing and Availability:

The property is subject to price and availability changes without notice, until executed contract has been returned to the property owner. No reservation is confirmed until approved and the full deposit has been received. Time is essential. All communication is by e-mail. Guest is advised to set their spam control and/or e-mail system to accept mail coming from klaush@acviews.com.

Payments:

Two payments are required: a US$300 rental Deposit and the rental Balance.
Payment of the Deposit is required to hold the reservation and is only acceptable by credit card via PayPal (you will be invoiced; no fee applies to this payment).  The Deposit will be credited toward the rent due for the rental period. 
The Balance will be due 30 days prior to arrival.  It can be arranged to pay the Balance by personal check (drawn on a United States banking institution only), by PayPal, or by funds transfer ("Überweisung") to a bank account in Germany.
The rental contract specifies all rents in US dollars.  The Currency Exchange Rates published at http://www.oanda.com/currency/converter/ and prevailing on the date of payment will be applied to payments made in Euros. 

Cancellation Policy:

The time factor is critical in vacation rentals, and your reservation will hold this rental off the market for a period of time.  The Deposit is not refundable.  If you cancel your reservation within 30 days of your check-in date, deposit and balance will be forfeitedIf you shorten your stay after check-in, there will be no refund of rents paid, or payable, for canceled nights. 
This policy is explicitly designed to discourage reservations for a time period longer than the intended or contemplated period of stay. For example, if you reserve 4 weeks and later reduce your reservation to 3 weeks, the one week reduction is considered a cancellation and subject to the above cancellation policy; i.e., if the notice reduction was received less than 30 days prior to the scheduled check-in date, the entire rental amount of the canceled time period is forfeited.
As a courtesy to our customers, in the event of a cancellation or early departure, the owner and Property Manager will work to find a tenant to occupy the vacated time reserved under this contract. If we are able to find a suitable tenant, we will refund those amounts recovered by re-rentals, less a US$100 service fee. The earlier you warn us that you may need to cancel, the better the chances of re-renting and refund.
Furthermore, the Owner will certainly work with you in the event that your cancellation is due to documented serious illness or other serious circumstances. THESE ARE EXCEPTIONS TO OUR POLICY TO BE EXERCISED AT THE OWNER’S DISCRETION.
You agree to assume responsibility for transportation to the property. Inconvenience caused by weather, disruption of utilities, taxi service, or road or air traffic conditions do not invalidate this Rental Agreement, nor will they be subject to financial compensation.

You are responsible for your choice:

This apartment is individually owned and managed. We have described our vacation rental in detail to the best of our ability, but we cannot make the decision for you and will not be responsible if you are not happy with your choice on arrival. The rent will not be refunded and cannot be transferred to another location.

Pets:

Our rental homes and Alegria are advertised as pet-free. We have new and repeat clients who rely on this for health reasons. It is therefore imperative that you strictly, without exception, adhere to our "no pets" policy. This pertains to the terrace as well: we must even deny any request to keep the pet on the terrace at all times.  We consider a violation of this policy as very serious.  Please understand that this is no judgment or prejudice against your wonderful dog, cat, hamster, or whatever your pet may be ... we are not pet-unfriendly, but our rentals are pet-free.  If our housekeepers determine that a pet was inside the premises, you will be charged for the expenses for shampooing and replacement of ruined carpeting, fabric and furniture.

Smoking, Abalone:

Smoking is not permitted anywhere inside the premises, nor on the wooden decks. Abalone handling is not permitted inside the house and in the hot tub area, with the exception of the utility sink in the garage.  Pounding of abalone is not permitted on the kitchen countertops.  If our housekeepers determine that these policies were violated, you will automatically forfeit your entire Security Deposit.  Furthermore, if this amount is insufficient to cover the expenses for related cleaning and repairs, you will also be liable for the additional related expense

Occupancy Limitations/Usage/Subletting:

The owners have set strict occupancy limitations (3 people) and extend further discounts to 2- or 1-person occupancy parties. Regardless of the number of sleeping accommodations deemed available in the apartment, there shall be no occupant beyond what is stated on the e-mailed Rental Confirmation. If more persons occupy the premises that are not specifically authorized by the owners, or if an extraordinary gathering takes place at or on the premises, this may cause the additional rents due, or eviction. We recognize the desire to have an occasional visitor, but additional charges may be incurred for other unauthorized use and over-night stay of unauthorized people. In addition, any type of subletting is strictly prohibited. Any disturbance resulting in neighborhood complaints or police action, other illegal activities, damage to the rental property, or violation of this agreement or of rules and regulations governing the rental unit, will be considered sufficient cause for immediate termination of your stay, and all monies paid will be forfeited. This agreement does not create a tenancy; you can be removed from the premises without process of law if you do not depart at the appropriate time.

Reservation/Security Deposit:

A refundable reservation/security deposit, as would be customary for short-term rentals world wide, is not required for the rental of Alegria, as we interpret your coming to a place as special as the Casa de Dom Inacio in Abadiania as an indication that you will adhere to all standards of reasonableness and courtesy with regard to treatment of our property

Upon Arrival:

When you arrive, please check the rental premises for cleanliness and damage. Please read all notices and instructions we have posted in various places in the apartment. We will assume that you will abide by the intent of these notes and agree to leave the premises in at least as good condition as you found it when you arrived. In particular, for your own personal benefit, please read the "Casa de Dom Inacio" rules and protocols we have posted for your convenience. 

Check-In and Check-Out; Keys:

Check-in time is 3:00 PM; check-out time is 11:00 AM. Early check-in and late check-out, if requested and desirable due to the arrival times of your flight, may be arranged but requires written communication with, and consent by, our Agent (Rex and Anne Smith, rex.smith.hope@gmail.com, +55(62)8424 8800 or +1(510)488-4478). 
We strongly recommend that you arrange for your taxi ride from the airport to Abadiania (costing approximately R$250, not included in the rent) through direct communication with the Agent.  They will then communicate with the taxi driver to call them when en route, to advise them of your exact arrival time at the property gate in Abadiania.  Our Agent will then greet you at the gate and lead you to your apartment.  

Linens and Towels:

Available for your use; beds are made upon your arrival. 

Cleaning/Housekeeping Charges/Policy:

  • Basic housekeeping service is included in your rental charges.
  • Our housekeepers will do interim service once per week, usually on Fridays, at which time they will deliver fresh linens and towels as required. This service is also included in your rental fee but does not include personal services, such as dish washing, laundry of personal items, shopping, or alike.
  • If you wish to receive additional, or more frequent, housekeeping service, this may be possible -- at an additional charge -- by an ad-hoc arrangement with our Agent.

Maintenance Interruptions:

You agree to notify the Agent immediately if a maintenance problem develops at your apartment, so we can have it remedied as quickly as possible. Owners and Agent reserve the right to make repairs as necessary, and to enter the apartment with reasonable notice, or without notice during the hours of 9AM and 5PM if you cannot be reached.
While Owner and Agent will make all reasonable efforts to rectify a maintenance problem as soon as possible, it may occasionally occur that, due to the nature of the problem and scheduling difficulties beyond Owners’ and Agent’s control, repair of a deficiency cannot be completed immediately. No refunds apply in the event that -- given Owner’s and Agent's diligence to arrange to have a maintenance situation rectified as soon as possible -- an appliance or amenity of the rental apartment, such as electric power, Internet service, or a washing machine, is unavailable during any part of the rental period.

Use at Your Own Risk:

The Owners and Agents are not responsible for personal injury or loss, theft or damage to your belongings during your stay due to causes outside of Owners’ or Agents’ control, or due to unsafe use of the premises and amenities, including but not limited to the shower stall and decks. You agree to hold Owners and Renters harmless in the event of related injury or loss, theft or damage. Owners and Agent are not responsible for their renters’ and guests’ own and their children’s safety while at the rented Apartment.  Renters are advised that certain aspects of the facilities, such as railings, electrical outlets and appliances, may not conform with European or United States building safety codes and tandards and may be hazardous if used inappropriately.

Utilities, Internet:

Utilities are included in the rental price. You have unlimited free use of the wireless Internet service available at the apartment. Please be aware that your cell phone will likely generate very high roaming charges if not roaming-protected.  We recommend that you keep your cell phone in the "airplane" mode and then turn on Wi-Fi and connect to the apartment's Internet system if so desired.

Use Restrictions:

The Condominium complex to which Alegria belongs is a resort with strict homeowners association guidelines which emphasize common-sense rules in this healing environment, including:

  • no trespassing onto neighboring properties (there are no fences -- please respect the privacy of others)
  • children must be supervised by an adult whenever outside the apartment -- they may not roam around uncontrolled and disturb the privacy of others
  • no noise annoyance to others -- respect others and keep voices and radios at low volume. 

Renter will be responsible for all violations committed by his/her party.

Keys, Intercom System:

Arrival: The Agent will provide a set of keys upon your arrival. Agent will also explain the functioning of the gate lock/intercom system.
Departure: Leave the keys on the kitchen table. 

Safe:

We provide a private hotel-type safe that can be closed and opened with a 4-digit code of your choice, or with any personal credit card.  Follow the simple written instructions on the equipment.  In case of accidental locking or malfunctioning, contact the Agent for assistance.
