Terms and Conditions for Rental of "Alta Vista Chalet"
By answering the question “Have you read the "Terms and Conditions for Rental of Alta Vista Chalet"? in the affirmative, or by payment of our invoice to reserve or book a rental period at Alta Vista Chalet, or by proceeding to an on-line reservation of Alta Vista Chalet, you agree that you have read and understand these terms and conditions and agree to abide by them. You understand and concur that, for reasons of expedience and for your convenience, we do not require mailing or faxing a formally signed Rental Contract but that, instead, this document, together with the personal data submitted with the e-mail into which it is incorporated, or with the data you submitting regarding yourself and the members in your group renting our premises, serves as a binding Rental Contract. Specifically, you agree to pay such charges as may be presented to you in writing and may result from careless treatment of the premises and/or not following these terms and conditions. And you agree that any controversy or claim arising out of, or relating to, this rental agreement, or the breach thereof, shall be determined by mediation-arbitration as is commonly practiced for resolution of real estate and/or vacation rental related disputes in the State of California, whereby the place of arbitration shall be Sunnyvale (CA, USA), and the language of arbitration shall be English. If the arbitration results in a judgment that is more (less) favorable to the owner's position, Renter (Owner) pays for all related costs and court fees, except for Owner's (Renter's) legal counsel, if any.

No more than 8 people, excluding infants under 6 months of age. Children age 6 and older are welcome but must be included in the head count. The number of children may not be more than the number of adults in your party. Exceptions must be confirmed in writing. We generally do not permit groups of juveniles; specifically, if there are four or more people in your group, there must be at least one person over age 40 or one child under age 12 in your group. Not meeting this criterion is a breach of contract, unless there is a written ad-hoc waiver by the owner.
Pets and Smoking:
NO PETS are allowed under any circumstances inside the premises (including the garages).
Smoking is not permitted inside the premises. Due to the extreme fire danger generally prevailing in the High Sierra mountains during the summer months, smoking is also prohibited on commons and the trails.
If our housekeepers determine that a pet was inside the premises, or if there was smoking, you will automatically forfeit your entire Security Deposit. Furthermore, if this amount is insufficient to cover the expenses for shampooing and replacement of ruined carpeting, fabric and furniture, you will also be liable for the additional related expense.
Panoramic views from all rooms; 2 gas fireplaces; gas grill; 2 levels of large wrap-around view decks, plus a large ground level view deck off the lower-level MBR; 3-car garage; one clothes washer and two clothes dryers; DW, microwave; one 40" and one 37" flat-screen TV on a DirecTV satellite contract in LR and upstairs MBR; 2 DVD players, phone with free long-distance; and free wireless Internet.
Pricing and Availability:
The property is subject to price and availability changes without notice, until the properly filled-out Rental Agreement, into which these "Terms and Conditions" have been incorporated, has been returned to, and accepted by, the property owner, or until on-line booking has been confirmed. No reservation is confirmed until the full deposit has been received. All confirmed reservations are final. Time is essential. With the occasional exception of mailing checks, all communication is by e-mail. Guest is advised to set his spam control and/or e-mail system to accept mail coming from firstname.lastname@example.org.
Except if this is an on-line booking (such as via Airbnb, HomeAway, TripAdvisor):
-- Two payments are required: a refundable Security Deposit ("Deposit") and the Rental Balance (consisting of the sum of (a) total rent, (b) cleaning/housekeeping charges, and (c) Town of Truckee TOT tax (10% of rent and cleaning fees) and TTBID tax (2% of rent and cleaning fees)).
-- Payment of the Security Deposit is required to hold the reservation and is only acceptable by credit card via PayPal (no credit card payment fees are applied to this payment).
-- If the rental date is within 30 days from date of booking, payment of the rental Balance is due immediately and can only be made via PayPal – no fees apply.
-- If the rental date is further out, the rental Balance is due no later than 30 days prior to the rental date and may be paid by personal check (U.S. Bank only) or by credit card via PayPal, in which latter case a 3% credit card fee co-pay applies.
-- For credit card payments, the Owner will issue a “Payment Request/Invoice” via PayPal by e-mail to the renter, upon which the renter can conveniently and utmost securely complete the payment; no PayPal account is required. No credit card data of the Renter will be divulged to the Owner.
-- Chasing after payments can be avoided with proper planning and is time consuming for the owner. A late payment of $50 will be automatically deducted from the Deposit for any check payments received after the due date, and for any credit card payments delayed without reasonable cause more than 24 hours from the time the invoice/request was issued. If payment is not made within 5 days of due date, the reservation may be canceled and the property may be opened up for other rentals, and moneys paid may be forfeited. Reservations may be reinstated, and forfeited moneys reapplied, upon payment of the amount due, if the property is still available, at the Owner’s discretion. You WILL NOT be reminded on any payment due dates, except the credit card payment via PayPal of the rental Balance.
If this is an on-line booking, the payment requirements of the booking agent (such as HomeAway, Airbnb, Tripadvisor) apply.
Except if this is an on-line booking:
The time factor is critical in vacation rentals, and your reservation will hold this rental off the market for a period of time. For cancellations made more than 30 days prior to your arrival date, we will refund all rents paid but YOU WILL FORFEIT YOUR ENTIRE DEPOSIT. THERE ARE NO REFUNDS OF RENT FOR CANCELLATIONS MADE LESS THAN 30 DAYS PRIOR TO ARRIVAL (you forfeit your entire rent, but we will refund your Deposit and cleaning fee if your Rental Balance had been paid in full).
However, as a courtesy to our customers, in the event of a cancellation, the owner will work to find a tenant to occupy the vacated time reserved under this contract. If we are able to find a suitable tenant, we will refund both the deposit, cleaning charges, and rental fee to the extent we have found an acceptable tenant for the time period, as determined by the Owner, less a $200 service fee. The earlier you warn us that you may need to cancel, the better the chances of re-renting.
Furthermore, the owner will work with you in the event that your cancellation is due to documented serious illness or other compelling circumstances. THESE ARE EXCEPTIONS TO OUR POLICY TO BE EXERCISED AT THE OWNER’S SOLE DISCRETION.
If this is an on-line booking, the cancellation policy of the booking agent (such as HomeAway, Airbnb, TripAdvisor) apply.
Weather Related Inconveniences:
As is the case with many vacation rental properties located in the High Sierra mountains, weather conditions may be adverse both for arrival and/or departure. Alta Vista is located on a road that is serviced for snow removal by the Town of Truckee. In addition, our property has essentially level street access, and we contract for a private driveway snow removal service which comes at minimum once per day if snow accumulation exceeds 4 inches. Typically, only very minor accumulation of snow immediately in front of the garage doors cannot be covered by that service and is all that you might have to clear yourself -- shovels are in the garage. Commensurate with the 7300 ft. elevation of Alta Vista, heavy snow and snow drifts can occur on the road, and -- as would apply for all winter sport resorts -- we advise our renters to use a 4-WD or, better yet, an AWD vehicle with tires in good condition, and to plan to arrive during daylight hours if heavy snowfall is in the forecast. Owners will not be responsible for any losses to renters due to snow conditions.
The snow removal contractor is fully insured. However, the renter is responsible for not leaving any vehicle or equipment, including a snow shovel, in the driveway area. Any damage due to, or caused by, such equipment, which became covered by snow and turned into a hazard for the snow removal equipment, is full responsibility of the renter.
You agree to assume responsibility for transportation to and from the property. Inconvenience caused by weather, disruption of utilities, or road conditions do not invalidate this Rental Agreement, nor will they be cause for any financial compensation or any other concessions. Specifically, Owner assumes no responsibility if you cannot arrive at, or depart from, the rental property at the agreed-upon timing. Owners may offer some ad-hoc arrangements to reduce such costs arising to you, e.g., staying for an extra night -- rental calendar permitting -- because of adverse driving conditions; but such arrangements are not entitlements and must be clearly confirmed by Owner in writing.
You are responsible for your choice:
This vacation rental unit is individually owned and managed. We have described our vacation rental home in detail to the best of our ability, but we cannot make the decision for you and will not be responsible if you are not happy with your choice on arrival. The rent will not be refunded and cannot be transferred to another location.
Owner encourages fair and reasonable reviews in the website through which our valued renters found our home, provided that this website offers the possibility of renter reviews. Renter agrees not to post reviews accessible to the general public anywhere other than to that website without Owner's written consent.
Owners have set strict occupancy limitations (8 people) and extend further discounts to smaller-occupancy parties. Regardless of the number of sleeping accommodations available in the home, there shall be no occupant older than 6 months beyond the number disclosed and represented by Renter. If more persons occupy the premises who are not specifically authorized by Owners, or if an extraordinary gathering takes place at or on the premises, this may cause a forfeiture of the deposit and eviction. If the Rental Agreement was for a certain number of people, and an additional person stays at the property for any one or more nights during the rental period, the additional rent and tax applicable for the additional person will become due and payable. We recognize the desire to have an occasional daytime visitor, but these additional charges may be incurred for sleepovers or other unauthorized use. In addition, any type of subletting is prohibited. The person whose name is listed on the accompanying Rental Comfirmation, or who proceeds with an on-line booking, shall be responsible for all people in his/her group. Any disturbance resulting in neighborhood complaints or Tahoe/Donner Association or police action, other illegal activities, damage to the vacation rental property, or violation of this agreement or of rules and regulations governing the vacation rental, will be considered sufficient cause for immediate termination of your stay, and all monies paid will be forfeited. If damages exceed the amount of the security deposit, you are liable for such additional amounts. This agreement does not create a tenancy for the vacation rental; you can be removed from the premises without process of law if you do not depart at the appropriate time. Tahoe/Donner Homeowners Association declares 10:00 PM to 7:00 AM as "quiet hours" and does not permit outdoor amplified sound during these hours.
A reservation/security deposit (“Deposit”) is required for each rental and will be returned subject to, but not limited by, the following:
- no infringement on the no pets, no smoking, no partying, and head count rules;
- no damage has occurred to the premises beyond normal wear and tear;
- no excessive cleaning was required due to Renters' negligence (including violation of the no pets/no smoking policy);
- no items are missing from the premises ($30 replacement fee for missing TD passes);
- garbage was not removed from house (to be placed in bear-proof enclosure); and
- there are no unpaid, late, additional person-, or outstanding rent or other charges owing.
Any material breach of the rental agreement or the general or specific home rules during your tenancy may be cause for forfeiture of up to the entire Deposit. Deposit refunds are mailed within 21 days of departure, usually just a day or two following departure.
When you arrive, please check the vacation rental premises for cleanliness and damage. Read the About This Home materials (on TV stand or kitchen counter) and Check-Out List (on kitchen countertop or refrigerator). Notify owner promptly of any problems or damage. You agree to leave the vacation rental premises in good condition and complete and check all items on the Check Out List, if one is presented, prior to departure.
Check-In and Check-Out:
Check-in time is 4:00 PM. Upon payment of all rental charges, you will receive the information necessary to obtain entry to the premises. The check-out time is 11:00 AM. Late check out, unless specifically pre-arranged with owner, is grounds for security deposit claims. Owner may grant earlier check-in and/or later check-out in certain rare circumstances that are outlined in http://searanchrentalhomes.com/acviews/FAQ-FV-checkin.htm.
Linens and Towels:
Linens and towels from our supplies are available for your use; beds are made upon your arrival.
We provide one fitted and one flat sheet per bed and one towel set (bath, hand, and face towel) per person on towel racks.
More supplies, as well as bath robes, are in the closets. However, if you make use of these additional supplies, we require that you wash and dry those and leave them folded on the dryer before you depart, or we may deduct $10 per extra set of sheets, $10 per extra set of towels, and $10 per bath robe from your Security Deposit.
Basic housekeeping service is included in your charges. Washing linens and towels is expensive in terms of housekeeping time and resources. To help our housekeepers, and to keep our general housekeeping charge in check, we kindly ask our renters to strip the fitted and flat sheets from the beds start the washing and drying cycles on the departure day, time permitting. Any laundry you might be able to complete -- highly appreciated -- before you depart should please be folded and left on the dryer. Please do NOT MAKE THE BEDS YOU USED. Our housekeepers are directed to assume that all beds they find made were not used by your party.
You agree to reasonably notify us immediately if a maintenance problem develops at your vacation rental home, so we can have it remedied as quickly as possible. Owners and Agent reserve the right to make repairs as necessary, and to enter the vacation rental with reasonable notice, or without notice during the hours of 9AM and 5PM if you cannot be reached for advanced notice. While Owner and Agent will make all reasonable efforts to rectify a maintenance problem as soon as possible, it may occasionally occur that, due to the nature of the problem and scheduling difficulties beyond Owners’ and Agent’s control, repair of a problem extends beyond the end of one rental into another rental period. No refunds apply in the event that an appliance or amenity of the rental home is unavailable during any part of the rental period, including, but not limited to, due to electric power and utility outages.

High Decks, Railings:
The Alta Vista Chalet is built on a sloping grade, and the main and upper level view decks are about 10 feet and 20 feet above grade, respectively. Children are often inquisitive and prone to do the unexpected. Before you even realize it, they might, for example, push a chair against the railing and be in SERIOUS jeopardy. Young adults might get the craziest ideas of games to play on the large deck areas, and renters and their guest at large might be impaired and in danger due consumption of drugs and/or alcohol ...
PLEASE KEEP YOUR CHILDREN UNDER CONSTANT SUPERVISION WHILE ON A DECK. PLEASE BE GENERALLY AWARE OF THE DANGERS OF DECKS HIGH ABOVE GRADE. SERIOUS INJURY OR DEATH CAN RESULT FROM FALLING OFF A DECK.
Use of Equipment, Slippery Decks and Pavement:
Owners do not consider the premises safe and suited for toddlers and preschool age children and have, therefore, set the a lower age limit of 6 years. Owners and their agents are not responsible for personal injury or loss, theft or damage to your belongings during your stay due to causes outside of Owners’ or Agents’ control, or due to unsafe use of the premises and amenities, including but not limited to the sauna, Jacuzzi tub, shower stalls, gas fireplaces, gas grill, and view decks, which may function differently than you expect them to, and uses of which are ALWAYS AND UNCONDITIONALLY AT YOUR OWN RISK. In particular, in the cold season, snow and ice may build up on decks, outside stairs, and in the driveway, causing slippery conditions that may lead to personal injury. Wooden decks can be slippery when wet, regardless of season. CONCOMITANT WITH YOUR RENTAL OF ALTA VISTA, YOU AGREE TO HOLD OWNERS HARMLESS IN THE EVENT OF RELATED INJURY OR LOSS, OR OF THEFT OR DAMAGE OF YOUR OR OUR PROPERTY.
Guests are not permitted to use Owner’s sports equipment or other gear that may from time to time be left in the garage (e.g., motor vehicles, sailboat, kayak, raft, bicycles, skis). Owners and their agents are not responsible for their renters’ and guests’ own and their children’s safety while at the rented vacation home. Guests are permitted to use the gas grill at their own risk, provided it is placed on the fireproof mat on which they will find it placed on upon arrival, at least 12” away from the house wall when in use, and the grease catcher is in place and operable.
Utilities, Telephone, Internet:
Utilities are included in the rental price. You have unlimited use of the telephone for local calls, as well as reasonable use of the house phone for long-distance (LD) and international calls. Cell phone coverage (by various providers, including Verizon and AT&T) is available at the home location. Free wireless Internet is available; however, this is a radio signal system which is limited to download speeds of about 5 Mbps (nominal). The password will be provided with the rental confirmation. However, the download speeds are not sufficient for extensive streaming. We recommend, instead, to download to your computer prior to arrival those Netflix and similar programs you want to watch during your stay at Alta Vista. Also, to watch programs from your laptop on our flat screen TVs, we recommend you bring your own HDMI cable.
The Tahoe-Donner (TD) Association has become increasingly apprehensive about short term vacation rentals ("STRs") and has severely restricted them. This is in response to increased numbers of complaints by locally resident homeowners about disruptive and disrespectful behavior of vacation renters. To preserve the continued enjoyment of Tahoe-Donner homes, including Alta Vista, by means of vacation rentals, please observe these specific restrictions:
- Guests may not use the rented premises for partying purposes. No visitors of renters may be on the premises after 9:30 pm.
- Amplified music is not permitted on the decks at any time; even when used inside, the sound level shall be kept down so it does not carry to a disturbance at neighboring properties.
- The flying of drones of any kind is prohibited (and subject to substantial TD Association fines payable by Guests).
- Lighting can severely disrupt the enjoyment and privacy of neighbors. Guests are required to turn all outside lights off when not required and requested to reduce inside lighting as appropriate during late evening and night hours.
- Disturbances: Any disturbance resulting in neighborhood complaints or TD Security or police notification, other illegal activities, damage to the vacation rental property, or violation of this agreement or of rules and regulations governing the vacation rental, will be considered sufficient cause for immediate termination of Guests’ stay, and all monies paid will be forfeited.
- no smoking on the trail system (year-round);
- No trespassing onto neighboring properties (there are no fences!) or onto commons (stay on trails);
- Speed Limit: Please observe the 25 mph speed limit on all internal roads, except if posted otherwise; furthermore, please respectfully reduce your speed when pedestrians are present.
- Quiet time is required between 10:00 PM and 7:00 AM
Renter will be responsible for all violations committed by his/her party.
Arrival: A code to a keyless entry device (on the front door) will be provided to you once the final payment has been received and/or your on-line reservation has cleared. First find and push the elongated "Schlage" button above the number key pad; the keys will then be illuminated. Enter the code and turn the knob clockwise to open the dead bolt. To lock, simply push the "Schlage" button and turn knob counter-clockwise. There is also a conventional key lock box, operable with the same code. It contains a mechanical door key which can be used in case the keyless entry system malfunctions.
Two wall-mounted garage door openers are also available, identically coded. Make sure to close the key pad lid immediately after use to prevent rapid battery drain. Read the specific instructions for these openers: on one the "send" button must be pressed following entry of the 4-digit code; on the other the code must be followed by "0" (by a zero).
Departure: Follow and check the Check-out List posted in the home -- disregard will result in claims on your deposit.
